Second Amendment protects an individual right to possess a firearm.

Quoting the syllabus: The Second Amendment protects an individual right to possess a firearm unconnected with service in a militia, and to use that arm for traditional lawful purposes, such as self-defense within the home.

Of course that does not mean the fight is over:
Washington, D.C. - Paul Helmke, President of the Brady Center and Brady Campaign to Prevent Gun Violence, issued the following statement:“Our fight to enact sensible gun laws will be undiminished by the Supreme Court’s decision in the Heller case. While we disagree with the Supreme Court’s ruling, which strips the citizens of the District of Columbia of a law they strongly support, the decision clearly suggests that other gun laws are entirely consistent with the Constitution.

So the NRA, GOA, & the other gun rights groups will still need help & support

From SAF: “But this fight is hardly over,” Gottlieb concluded. “Today’s ruling is a stepping stone, the foundation upon which we can rebuild this important individual right. Our work has only just begun.”

Sheep can't do much

The story has been all over the net about the guy stomping & beating his 2 yr old son to death, how 10 people stood by & did very little to stop the man or his attack.

But sheep lack the tools & the training, & they really don't have the stomach for violence.

Very few do, the wolves, jackals and the hyenas, because they know what they want can be taken by force, and the sheep are for the most part helpless to stop it.

That's where sheepdogs come in, but states like California detest sheepdogs, they want the police to handle it.

But don't blame the sheep, they can learn & they can train and perhaps be better prepared the next time. But they have to be willing to come over to the dog side, & some just can't do it.

Last week a boyscout camp got hit by a tornado, but instead of acting like a bunch of frightened children, the scouts did what they were trained to do give first aid, recover the dead & wounded, but without the training they would have been a bunch of scared kids & more of them might have died..

We are only overwhelmed when we don't know what to do.

Obama wants payroll tax on incomes above $250,000

The 6.2 percent payroll tax is now applied to all income up to $102,000 a year, which covers the entire amount for most Americans. Under Obama's plan, the tax would not apply to incomes between that amount and $250,000. But all annual income above the quarter-million-dollar amount would be taxed under his plan. From the AP

So you will be taxed if you make up to $102,000, or over $250,000 #1 I'm not sure anyone I know even makes $100,000 a year # 2 I certainly don't.
So is Barack Don't ask Questions Obama, is defining the middle class as those that make over $100k a year, & would like the poor & the rich to support them. I can see why people who make the kind of money might have hope & want change. But if you are a poor working stiff, making under $40 a year, you'll just pay more baby.
Of course for those that make over $250k a year they can likely absorb the increase slightly better, but isn't there a cap on what SS pays? So won't they pay more to collect less?

From here is a summary of the changes in SB184.
For all law-abiding citizens (Not just gun owners)
Castle Doctrine: If someone breaks into your occupied home or temporary habitation, or your occupied car, you have an initial presumption that you may act in self defense. The prosecutors may overcome this presumption if illegal activity was happening or other extenuating circumstances, such as a husband and wife domestic violence situation.
Civil Immunity: Crime victims will be immune from civil actions from their attackers and their families for actions that cause a criminal to be harmed or killed.
Now, when the Act becomes law, and as long as there are not any extenuating circumstances, the case ENDS and the healing begins. No hauling off to jail. No worries about criminal trial and the whims of a jury. No civil suit from the bad guy’s family.
Duty to Retreat: A person who is lawfully in their residence or vehicle has no "duty to retreat" before using force in self-defense or defense of another.

For all gun owners:
Definition of a "loaded" gun.
SB184 will eliminate all the vague "ready at hand" language that has been bastardized in our courts and provide a simple way you can be sure you can legally transport your firearm. Simply put, the gun must be unloaded. An unloaded gun has no bullet in the chamber or cylinder. You may not have any loaded speed loaders or magazines for the gun in question anywhere in the motor vehicle. There are no longer any rules about where the gun or the ammo must be, or their relation to each other.

Section 2923.16 will be the only section controlling firearms transported in cars. Restrictions in other sections will apply outside of vehicles.
Carrying concealed weapons in one's own home will not require a concealed handgun license (CHL).

If a gun is seized and later ordered to be returned to the owner, and the police refuse to return the property and legal action is successful in getting property returned, it is mandatory that legal fees be reimbursed.

Concealed Handgun License (CHL) changes:
A CHL holder will be permitted to carry in a government owned building that is not a government facility where business is generally conducted. A CHL will be able to posses firearms in government owned parking garages, rest areas, and shelters. Carry in a BMV is prohibited.
The criminal penalty for a CHL carrying in a "no guns" parking lot is eliminated. The property owner retains a cause for an action for civil trespass.

A CHL holder will be permitted to pick-up/ drop-off a child in a the designated area of a school safety zone.

A CHL holder will be permitted to carry in retail facilities that sell alcohol for consumption off premises. (Giant Eagle, Wal-Mart, carry-out) as long as the license holder is not consuming alcohol and is not under the influence of alcohol or drugs.
The holder of a liquor permit for consumption on premises who has a CHL will be permitted to carry in his/her own establishment, and will be permitted to hire police to provide security, including inside the liquor establishment.
Sealed and expunged records will no longer be disqualifying offenses and will not preclude persons from obtaining an Ohio CHL.

If a person fails to notify a police officer that they are armed during an official stop, and the license holder can prove that the officer had information that he was a CHL, the penalty will be reduced. NOTE: It is still required to notify police that you are armed and this change does NOT change or reduce your obligation to inform law enforcement when you are armed.
A CHL holder will be permitted to have a loaded handgun in an unlocked glove compartment and a center console in an automobile.
A landlord may not evict a tenant for owning a lawful firearm or possessing a concealed carry license.
The requirement for a written test during the re-qualification process is eliminated. A practical test is still required.
Blogging has been light

Spent the entire past weekend teaching pistol classes, & then Monday, Tuesday, & Wednesday
attended the 3 day "Street Crimes" Seminar in Cincinnati. So I've been a bit busy.

So I missed covering the mass stabbing in Japan, 17 victims, but it hardly did a blip on the rader screen, now if that sucker could have just got his hands on an AK47 then we would still be hearing about it.

Shame it happened but the response was outstanding

They not only had the equipment they needed, but they also had the training to use it, very cool.

"They knew what to do, they knew where to go, and they prepared well,"

It is the same with self defense, if you do not train & prepare, you will be relying on luck rather than skill, & if you are unprepared more likely to panic, with the training they saved their fellow scouts, instead of waiting for the professionals to get there.
A lot like calling 911 & the police are only minutes away....
